Wallpaper created using the Wallpaper Hub are owned by the person or entity that created them. We or anybody else involved in the development of the application does not take any ownership or responsibility for the content created using the app.
Anybody using the Wallpaper Hub agrees to only use their own photos, images or any graphic designs or those you have explicitly asked for a written permission from to use in this app or to create a wallpaper.
You may access and use content only for personal purposes via the functionalities provided by the service. You must not misuse the Services or Software. For example, you must not:
(1)copy, modify, host, stream, sublicense, or resell the Services or Software;
(2)enable or allow others to use the Services or Software using your account information;
(3)use the Software to construct any kind of database;
(4)access or attempt to access the Services or Software by any means other than the interface we provide or authorize;
(5)circumvent any access or use restrictions put into place to prevent certain uses of the Services or Software;
(6)share Content, or engage in behavior that violates anyone’s intellectual property rights (“Intellectual Property Rights” means copyright, moral rights, trademark, trade dress, patent, trade secret, unfair competition, right of privacy, right of publicity, and any other proprietary rights);
(7)upload or share any Content that is unlawful, harmful, threatening, abusive, tortious, defamatory, libelous, vulgar, lewd, profane, invasive of another’s privacy, or hateful;
(8)impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
(9)attempt to disable, impair, or destroy the Services and Software;
(10)upload, transmit, store, or make available any Content or code that contains any viruses, malicious code, malware, or any components designed to harm or limit the functionality of the Services or Software;
(11)disrupt, interfere with, or inhibit any other user from using the Services or Software (such as stalking, intimidating, or harassing others, inciting others to commit violence, or harming minors in any way);
(12)engage in chain letters, junk mails, pyramid schemes, phishing, spamming, or other unsolicited messages;
(13)place an advertisement of any products or services in the Services except with our prior written approval;
(14)use the service for commercial purposes (unless you have prior written approval from us);
(15)use any data mining or similar data gathering and extraction methods in connection with the Services, or violate applicable law (including, but not limited to, where applicable, COPPA).
We have some community guidelines in place. Violations (such as attacking or demeaning an individual or group, harassment, intimidation, or content not permitted by Apple App store policies, etc.) may result in permanent bans from the service. All violation content will be removed without notice.
By purchasing products or services directly from us, you authorize us to charge the associated fees via your chosen payment method. Subscriptions will renew automatically at the end of each subscription period, unless cancelled by you.
All risks related to the use of the service are solely your responsibility. We and our officers, directors, employees, and agents make no warranties, express or implied, and assume no liability for any content, errors, omissions, etc. in the service. Furthermore, we and our officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages that may be incurred by you through your use of the service.
To the extent permitted by applicable law, You agree to defend, indemnify and hold harmless Daily, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, and expenses (including but not limited to attorney’s fees) arising from:
(1) your use of and access to the Service;
(2) your violation of any term of the Terms of Service;
(3) your violation of any third party right, including without limitation any copyright, property, or privacy right; or any claim that your Content caused damage to a third party. This defense and indemnification obligation will survive the Terms of Service and your use of the Service.
We may revise these Terms from time to time. These terms are generally subject to change without notice. However, if the revision, in our sole discretion, is material, we will notify you via a banner notice across our website's page or other appropriate means. By continuing to access or use the Services after the effective date of these revisions, you agree to be bound by the updated Terms.
